1. Agreement
These Terms of Service ("Terms") govern your access to and use of Dakotime ("Dakotime", "the Service", "we", "us"), including the website at dakotime.app and any related applications, APIs, or features. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use Dakotime. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Accounts
You are responsible for the activity that occurs under your account and for keeping your login credentials confidential. Notify us promptly at support@dakotime.app if you suspect unauthorized access. We may suspend or close accounts that are inactive for an extended period, with reasonable notice where practical.
4. Acceptable use
You agree not to use Dakotime to:
- Violate any applicable law, regulation, or third-party right.
- Upload or transmit malware, exploits, or harmful code.
- Probe, scan, or stress-test the Service or its infrastructure without our written permission.
- Reverse-engineer, scrape, or attempt to extract source code or data beyond what is exposed by the documented user interface and APIs.
- Send spam, phishing, or unsolicited bulk messages through connected mail accounts.
- Impersonate any person or misrepresent your affiliation with any person or entity.
- Use the Service to build a competing product, or to train machine-learning models on data you do not own.
We reserve the right to suspend or terminate access for any conduct we reasonably determine violates these Terms or harms other users, third parties, or the Service.
5. Your content
You retain all ownership rights in the projects, tasks, notes, time entries, and other material you create in or upload to Dakotime ("Your Content"). You grant us a limited, worldwide, royalty-free licence to host, store, transmit, back up, and display Your Content solely to provide the Service to you. This licence ends when you delete the relevant content or your account, except to the extent we are required to retain it for legal or backup-rotation reasons (see the Privacy Policy).
You are responsible for ensuring you have the right to upload Your Content and for keeping your own copies. We are not a backup service.
6. Third-party integrations (Google / Gmail)
Dakotime optionally integrates with Google services, including Gmail, so you can attach mail accounts to projects. By connecting a Google account, you also agree to Google's Terms of Service and Privacy Policy. Our handling of Google user data is described in detail in our Privacy Policy and complies with the Google API Services User Data Policy, including the Limited Use requirements. You may revoke Dakotime's access at any time from the project's Accounts tab or from your Google account's security settings.
7. AI features
Dakotime includes AI assistants and automated planning features ("Dako", task weighing, plan generation, drafted email replies). These features rely on third-party language-model providers and may produce inaccurate, incomplete, or unexpected output. You are responsible for reviewing AI-generated output before acting on it, particularly before sending email, making decisions of consequence, or billing a client.
8. Pricing
Dakotime is currently provided free of charge. We may introduce paid plans or paid features in the future. If we do, we will give you reasonable advance notice and an opportunity to choose whether to continue. Existing free-tier data and accounts will not be deleted simply because paid plans are introduced.
9. Termination
You may stop using the Service at any time and delete your account from the settings page. We may suspend or terminate your access if you breach these Terms, if your use creates legal or security risk for us or other users, or if we discontinue the Service. Provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, governing law) will survive.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. You use the Service at your own risk.
11. Limitation of liability
To the maximum extent permitted by law, in no event will Dakotime, its developer, or its suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, business interruption, or loss of goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim or (b) USD 50.
12. Indemnification
You agree to defend, indemnify, and hold harmless Dakotime and its developer from any claim, liability, damage, or expense (including reasonable legal fees) arising out of your use of the Service, Your Content, your breach of these Terms, or your violation of any law or third-party right.
13. Changes to the Service or these Terms
We may modify or discontinue features at any time. We may also update these Terms; material changes will be announced in-app and/or by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. The "Last updated" date at the top of this page always reflects the current version.
14. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which Dakotime's developer resides, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the competent courts of that jurisdiction, subject to any mandatory consumer-protection rights you have under the law of your country of residence.
